These Terms and Conditions (“Terms”) govern your use of the Beaver Tools software and services provided via beavertools.app. These Terms apply to all Beaver Tools applications—both free and paid. By downloading, installing, or using any Beaver Tools application, you agree to be bound by these Terms.

1. Service Description

Beaver Tools provides macOS applications designed to assist with productivity, measurement, and utility tasks on Apple Mac computers. The service includes free applications as well as paid applications that unlock additional functionality or usage rights.

Where an application (or part of it) includes open-source components, those components are governed by their respective open-source licenses. These Terms govern your access to proprietary software, licensing services, updates, support, and any related non-code services provided by the Provider.

2. Eligibility

To use Beaver Tools, you must:

• Be at least 18 years old;
• Have the legal right to install and run software on your Mac device;
• Agree to and comply with these Terms.

3. Licenses, Pricing & Refunds

• Free applications: Provided at no charge.
• Paid applications: Sold as one-time purchases unless otherwise stated. Payment is required to download, activate, or use paid software.
• Refunds: All sales are final. Refunds are only issued if required by applicable consumer protection law.
• Taxes/VAT: Prices may include or exclude taxes depending on your location and applicable law.

4. Support & Updates

• Free applications: Provided without guaranteed support or updates (best-effort only).
• Paid applications: May include updates and email support, unless otherwise stated. Response times are not guaranteed.

5. External Services & Data Use

Some applications or features may communicate with external services to function properly (e.g., license verification, update checks, analytics, or API services). By enabling and using such features, you consent to these communications and the processing of necessary technical data. For details on personal data handling, please refer to the applicable Privacy Policy.

6. User Responsibilities

You are solely responsible for:

• Installing, configuring, and using the applications on compatible macOS systems;
• Maintaining appropriate backups of your data;
• Ensuring system compatibility (macOS version, hardware, third-party software);
• Complying with all applicable laws and regulations;
• Using the applications only for lawful and ethical purposes.

7. No Warranty / Disclaimer

Free applications: Provided strictly “as is” and “as available”, without any warranty of any kind, express or implied.

Paid applications: Provided “as is” and “as available”. The Provider disclaims all express and implied warranties, including (without limitation) warranties of performance, accuracy, non-infringement, merchantability, and fitness for a particular purpose.

You use Beaver Tools applications entirely at your own risk.

8. Limitation of Liability

Free applications: To the maximum extent permitted by law, no liability is accepted for any damages of any kind arising from use or inability to use the applications.

Paid applications: To the maximum extent permitted by law, the Provider’s total aggregate liability for all claims related to a paid application is limited to the amount you paid for that application in the 12 months preceding the event giving rise to the claim. In no event shall the Provider be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, data loss, or business interruption.

9. Termination

• By you: You may stop using the applications at any time. No refunds will be issued.
• By the Provider: The Provider may suspend or terminate access to paid software or services if you violate these Terms or use the software unlawfully.
• Effect of termination: Termination may end access to paid applications, updates, or support. Any open-source components remain governed by their respective licenses.

10. Intellectual Property

All rights, title, and interest in and to Beaver Tools (including applications, trademarks, branding, and documentation) are owned by the Provider, subject to any third-party or open-source components under their respective licenses.

11. Changes to Terms

The Provider may update these Terms at any time. Updated Terms will be posted on beavertools.app. Your continued use of the applications after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law & Venue

These Terms are governed by the laws of Germany. Exclusive venue for any disputes shall be the courts of Düsseldorf, Germany.
